Adsomnia – Code of Conduct
This document, henceforth referred to as the “Code of Conduct,” is formulated to ensure the protection of rights and safety of all stakeholders. It is imperative to acknowledge that each Affiliate remains autonomously responsible and liable for their actions. Adsomnia expressly disclaims any liability for the conduct of its Affiliates and for content hosted on external websites.
General Obligations
Compliance with Laws and Regulations
Affiliates shall adhere strictly to all applicable laws, statutes, and regulations governing their activities, including but not limited to, those related to marketing, privacy, social media, consumer protection, and advertising. Furthermore, Affiliates are obligated to align their practices with industry-standard best practices and guidelines.
Prohibitions and Requirements
- Affiliates are prohibited from engaging in any illegal, unlawful, or otherwise inappropriate conduct, including but not limited to criminal offenses such as discrimination, defamation, and privacy violations, as well as the dissemination of malware.
- The utilization of personal data is contingent upon securing prior written consent from the concerned individual.
- Adherence to guidelines issued by regulatory authorities is mandatory, ensuring transparency and honesty in endorsements and reviews.
- Affiliates shall not disseminate false or misleading information, nor shall they manipulate or obscure any disclosures.
- Compliance with the policies of third-party services, including social media platforms and marketing tools, is required.
- The use of incentives for promotional purposes without explicit authorization is forbidden.
- All pricing information and affiliate links must be used responsibly, without misrepresenting the nature of the Affiliate’s relationship with Adsomnia.
Use of Automated Systems
Affiliates utilizing automated systems must ensure that such use does not result in any breach of this Code.
Responsibility for Content
Affiliates bear sole responsibility for the development, operation, and maintenance of their website(s) and the content therein. Adsomnia disclaims responsibility for third-party content, notwithstanding the provisions of our Notice and Takedown Procedure.
SPAM Regulations
Affiliates must comply with all applicable anti-SPAM legislation, ensuring that email campaigns are conducted ethically and transparently.
Content Removal Obligation
Upon termination of participation, Affiliates are required to promptly cease the use of Adsomnia content.
Consumer Complaints Resolution
Affiliates commit to addressing consumer complaints within a 24-hour timeframe, in accordance with Adsomnia’s established procedures.
Privacy Policy Requirements
Affiliates are obliged to maintain a privacy policy that complies with all relevant privacy laws and regulations.
Cooperation with Investigations
In the event of an alleged breach of this Code, Affiliates are required to cooperate fully with Adsomnia’s investigations.
Disclosure in Case of Breach
Affiliates acknowledge that a breach of this Code may necessitate the disclosure of their identity under certain circumstances.
Binding Agreement
Affiliation and agreement to these terms signify the Affiliate’s entry into a legally binding contract with Adsomnia.
Amendment and Acceptance
Adsomnia reserves the right to amend this Code at any time, with such amendments becoming effective immediately upon notification.
Consequences of Violation
Affiliates acknowledge that violations of this Code may result in termination from the program, forfeiture, and the obligatory return of commissions obtained in breach of this Code.
